1. Purpose

These General Terms of Sale govern all purchases made on www.rootnpeak.com. By placing an order, you fully accept these terms. We keep things simple, transparent, and fair.

2. Our Products

Root & Peak offers a curated selection of fine foods from artisanal producers worldwide. We strive for complete honesty in our descriptions: specific dietary labels (such as non-GMO or gluten-free) are only stated when strictly applicable and verified. Product photos are for illustrative purposes.

3. Customer Account

To process your order and ensure proper tracking, creating a customer account is required. Please ensure your provided details (especially your shipping address and email) are accurate and up to date.

4. Orders & Contract

Your order is confirmed, and the sales contract is formed, once payment is successfully processed. We reserve the right to cancel any order in the event of suspected fraud, pricing errors, or stock issues (in which case you will be fully refunded).

5. Prices & Secure Payment

Prices are displayed in CHF. Payments are processed securely via Stripe (Credit Card) or PayPal. We do not store your payment details.

6. Shipping & Delivery

Areas: Switzerland and the European Union.

Timelines:

• 5 to 7 business days for stock shipped from Switzerland;
• 2 to 3 weeks for exclusive items shipped directly from their country of origin.

Fees: Shipping costs decrease based on your total order amount and are clearly displayed at checkout.

Note: Orders are shipped to the exact address you provide. We cannot be held responsible for delivery failures due to incorrect addresses.

7. Returns & Right of Withdrawal

We want you to be fully satisfied. You have 30 days from delivery to change your mind and return an item.

The Food Exception: For health and hygiene reasons, food products that have been unsealed, opened, or are highly perishable cannot be returned or refunded.

Returned items must be in their original, unopened condition. Return shipping costs are your responsibility. If a product arrives defective or does not match your order, please contact us immediately for a replacement or refund.

8. Liability

We do our best to ensure smooth deliveries, but we cannot be held responsible for delays caused by shipping carriers or events outside our control (force majeure).

9. Data Protection & Privacy

We respect your privacy. Your personal data is processed securely and in compliance with the GDPR and the Swiss FADP. We use it to fulfill your orders and, strictly with your consent, for targeted marketing. 10. Applicable Law & Jurisdiction

These terms are governed by Swiss law. For our B2C customers in the European Union, this does not deprive you of the mandatory consumer protection rights of your country of residence. In case of an unresolved dispute, the competent courts are those of the Canton of Vaud, Switzerland.
